Data published on MD Atlas concerning medical devices, in vitro diagnostic medical devices and their manufacturers / economic operators is sourced from EUDAMED, the European medical-device database managed by the European Commission. This data is public and made available under Regulations (EU) 2017/745 and 2017/746.
Terms of Use
1. Definitions
“Terms”: these general terms of use of the Site that all Users must comply with.
“Site”: the website of Made In Tracker, called MD Atlas, accessible at the following URL: md-atlas.com (and dm-atlas.fr), and any sub-domains.
“User”: any person using the Site, whether registered or not.
“EUDAMED data”: all public information relating to medical devices, in vitro diagnostic medical devices, manufacturers, authorized representatives, importers and other economic operators, as made available by the European Commission through the EUDAMED database.
2. Purpose
These Terms govern the conditions under which the User uses the Site and accesses the database of medical devices and their companies offered by MD Atlas.
By using the Site, the User accepts these Terms. They apply for the entire duration of use of the Site.
The version of the Terms currently online on the Site is the only one applicable and enforceable against the User until a new version replaces it. Made In Tracker reserves the right to modify these Terms at any time; the new version takes effect upon publication on the Site.
Any tolerance in the application of these Terms shall not be construed as a waiver by Made In Tracker of its right to enforce them later.
If any provision of these Terms is or becomes void under any present or future statutory provision, it shall be deemed unwritten without affecting the validity of the other stipulations.
3. User behaviour
The User undertakes to browse the Site in compliance with the instructions appearing on screen. The User shall not use the Site in a way that contravenes applicable regulation, public order, public morality, or that harms the interests, reputation or image of Made In Tracker or the rights of third parties.
In particular, without limitation, the User undertakes to comply with the following rules in their use of the Site:
- comply with applicable laws and respect third-party rights, and these Terms;
- use the Site fairly, for personal purposes and in compliance with applicable legal, regulatory and customary provisions;
- respect the intellectual property rights attached to the content provided by Made In Tracker and third-party intellectual property rights. Accordingly, the User shall not reproduce and/or communicate to the public all or part of the content published on the Site outside the cases authorized by law or by the EUDAMED data-usage terms;
- not divert or attempt to divert any of the Site's features from their normal use as defined herein;
- not use, in order to browse the Site, any software robot, crawler, scraper or other equivalent automated process or tool intended to extract Site data en masse;
- not disseminate any defamatory, insulting, obscene, offensive, violent content or content inciting violence, or content of a political, racist or xenophobic nature, and more generally any content contrary to applicable laws and regulations or public morality;
- not disseminate any content that diminishes, disrupts or prevents the normal use of the Site, or interrupts and/or slows down the normal flow of communications between Users;
- not collect information about third parties, including email addresses or personal data extracted from economic operators' records, to use them for commercial solicitations or equivalent purposes, to integrate them into a directory or equivalent service (free or paid), or to carry out unauthorized competitive intelligence.
In the event of a breach of one or more of these rules, Made In Tracker reserves the right to block the User's access to all or part of the Site, temporarily or permanently, without compensation or notice.
4. Site management
For the proper management of the Site, Made In Tracker may at any time:
- suspend, interrupt or limit access to all or part of the Site, or reserve access to the Site, or to certain parts of the Site, to a specific category of User (for example, account or subscription holders);
- delete any information that may disrupt operation or violate national or international laws;
- suspend the Site to carry out updates, maintenance operations or technical changes.
5. Made In Tracker's liability
Made In Tracker takes great care in building and updating the Site. However, the User acknowledges that Made In Tracker does not control the source data and information published by the European Commission through EUDAMED. Made In Tracker therefore does not guarantee that the data displayed on the Site is exhaustive, accurate, up to date, error-free or complete, nor that it fully meets the User's expectations.
The User expressly acknowledges that the data published on MD Atlas is not official and that, for any critical regulatory use (in particular when placing a device on the market, in vigilance operations or proceedings before a competent authority), it is the User's responsibility to verify the information directly with the official EUDAMED portal or the relevant competent authority.
Consequently, Made In Tracker's liability may not under any circumstances be engaged in connection with the use of the Site or its content by the User or any third party.
Made In Tracker undertakes to use its best efforts to ensure Users accessibility and availability of the Site at all times. However, its liability cannot be engaged:
- in the event of unavailability of the Site, for any reason;
- where the Site is incompatible with, or malfunctions with, certain software, configurations, operating systems, or User equipment;
- in the event of a power cut or failure of a technical provider (hosting, connectivity, etc.).
The User declares to be familiar with the vagaries of the Internet, its characteristics and limits, and acknowledges and is aware in particular:
- of the possibility of suspension or impossibility of access to the Site;
- that data transmissions over the Internet have only relative technical reliability and may be subject to saturation at certain times of the day;
- that data circulating over the Internet is not protected against possible misappropriation;
- that the Site may be subject to intrusions by unauthorized third parties and attacks of any nature.
Made In Tracker's liability cannot be engaged as a result.
The User's equipment used to connect to the Site is under their sole responsibility. The User must take all appropriate measures to protect their equipment and their own data, in particular against viral attacks via the Internet.
Made In Tracker cannot be held responsible for hyperlinks on the Site leading to other websites it does not control. Made In Tracker is not responsible for the content and availability of these sites, including links to the EUDAMED portal, national competent authorities' websites, or any third-party site.
6. Illegal content
Made In Tracker invites any User to report any problem, data error or content appearing to be illegal, offensive, shocking or contrary to morality by writing to contact@madeintracker.com. In such cases, Made In Tracker may take any measure it deems necessary in the event of unauthorized or illegal use of its Site.
For corrections of regulatory data (device or manufacturer records), Made In Tracker reminds Users that the official source remains EUDAMED; requests for substantive correction must be addressed directly to the competent authority that issued the information.
7. Intellectual property
Site copyright
Made In Tracker implements legal and technical measures to protect intellectual property rights.
Made In Tracker undertakes, as far as possible, to:
- inform its Users about their obligations regarding the use of protected content;
- contribute to the action of competent authorities in the fight against counterfeiting upon request.
The Site as a whole, as well as each of its components taken independently — in particular trademarks, specific programs and developments, enriched database, graphic charter, visualizations, classifications and groupings — is the exclusive property of Made In Tracker. Nothing in these Terms shall be construed as transferring any of Made In Tracker's intellectual property rights to the User.
Only a personal, non-exclusive, non-assignable and non-transferable right to use the Site is granted to the User.
Accordingly, the User may not under any circumstances:
- reproduce, represent, use, distribute, by any means and in any form or on any medium, the Site, or any constituent element of the Site (text, photo, image, video, sound, software, trademark, logo, corporate name, or any other distinctive sign…), except for strictly private purposes, provided that all copyright notices and other legal notices appearing on the originals are preserved on printed copies;
- extract, by permanent or temporary transfer, or re-use, by making it available to the public, all or any qualitatively or quantitatively substantial part of the records, classifications and other databases present on the Site, or carry out repeated and systematic extraction or re-use of qualitatively or quantitatively insubstantial parts where those operations manifestly exceed normal-use conditions;
- exploit, market, distribute for the benefit of third parties, in any form whatsoever, the Site, any constituent element of the Site, the records and other databases present on the Site;
- modify, remove, alter, by any means and in any form or on any medium, all or part of the various intellectual property and copyright notices appearing on the Site.
Any use not in compliance with the above provisions is unlawful and shall give rise to prosecution. The fact that Made In Tracker does not initiate proceedings upon becoming aware of such unauthorized uses does not constitute acceptance of those uses or a waiver of legal action.
Public sources and EUDAMED data
Raw EUDAMED data is public data made available by the European Commission pursuant to Regulations (EU) 2017/745 and 2017/746. Its re-use is governed by the conditions published by the European Commission. Made In Tracker claims no exclusive rights over the source data; however, it claims its own rights over the Site's architecture, its enriched database (consolidation, structuring, indexing, classifications, cross-referencing, additional data), its editorial content and its interface.
Database
The User acknowledges that the Site is made up of one or more databases made available by Made In Tracker as producer of those databases within the meaning of Articles L341-1 et seq. of the French Intellectual Property Code. This producer status results from the substantial investments (financial, material and human) made by Made In Tracker for the building, verification, enrichment and presentation of the database content.
Accordingly, any extraction and/or re-use of the database(s) within the meaning of Articles L342-1 and L342-2 of the French Intellectual Property Code is prohibited without Made In Tracker's prior written authorization.
8. User accounts and subscriptions
Some features of the Site may be reserved for Users holding an account or subscription. The User undertakes to provide accurate information when registering and to keep it up to date. The User is solely responsible for the confidentiality of login credentials and for all actions performed from the account.
Made In Tracker reserves the right to suspend or delete any account in the event of a breach of these Terms, fraudulent use, or abnormal activity (in particular, automated data extraction).
9. Technical support – Complaints
For any technical information or complaint, the User is invited to contact Made In Tracker at contact@madeintracker.com or via the “Contact” section of the Site.
10. Personal data
All personal data processing carried out by Made In Tracker complies with the Personal Data Protection Policy available on the Site at md-atlas.com/privacy.
11. Governing law and jurisdiction
These Terms are governed by French law.
In the event of a claim by either party concerning the interpretation or performance of these Terms, Made In Tracker and the User shall attempt in good faith to reach an amicable settlement.
Failing an amicable settlement, any dispute between Made In Tracker and the User relating to the use of the Site shall fall under the jurisdiction of the competent French courts.
